Terms and conditions

By registering for GrainGrowers events, you agree to accept these terms and conditions. GrainGrowers reserves the right, in its discretion, to cancel any registrations that do not comply with these terms and conditions, or if GrainGrowers considers that there is reputational risk to the organisation. GrainGrowers reserves the right to update the terms and conditions without notice. In these terms, we refer to GrainGrowers as “our”, “we, or “us” and the Delegate as ‘’you’’ and ‘’your’’.

Privacy Policy

By registering for this GrainGrowers event, you acknowledge and agree that GrainGrowers will handle your personal information for the purposes set out in these terms and conditions, and as set out in the GrainGrowers privacy policy. Please refer to the GrainGrowers privacy policy at https://www.graingrowers.com.au/privacy-policy/ for more information regarding how your personal information will be collected, stored and used, as well as how you can request access to (or correct) the personal information that GrainGrowers holds about you.

Limitation of Liability

(a) (Limitation of liability) To the maximum extent permitted by applicable law, the maximum aggregate liability of GrainGrowers to the Delegate in respect of loss or damage sustained by the Delegate under or in connection with this agreement is limited to the total fees paid to GrainGrowers by the Delegatein the 3 months preceding the date of the first event giving rise to the relevant loss or damage.

(b) (Indemnity) The Delegate agrees at all times to indemnify and hold harmless GrainGrowers and its officers, employees, agents and contractors (Those Indemnified) from and against any loss (including reasonable legal costs) or liability incurred or suffered by any of Those Indemnified where such loss or liability was caused or contributed to by the Delegate's

(i) breach of any term of this agreement; or

(ii) negligent, fraudulent or criminal act or omission.

(c) (Consequential loss) GrainGrowers will not be liable for any incidental, special or consequential loss or damages, or damages for loss of data, business or business opportunity, goodwill, anticipated savings, profits or revenue arising under or in connection with this agreement or any goods or services provided by GrainGrowers, except to the extent this liability cannot be excluded under the Competition and Consumer Act 2010 (Cth) or any other applicable law. 

Photography

Participation in GrainGrowers events may involve photography, audio, and video recording. We may photograph or record any part of the events, including photography and recording footage featuring the Delegate (Event Media).

You consent for the Media to be used by or on behalf of us for publication on our Website, in our marketing and promotional material, and on any other website or in any media we may select for publication.

You assign (including as a present assignment of future copyright) and transfer to us all right, title and interest (including intellectual property rights) in and to the Event Media, free from any encumbrances or other security interests, including all rights, claims, demands, causes of action, rights of action past, present or future arising out of, or in relation to, the Media.

You release us from, and indemnify us against, all claims, actions, demands and liabilities in relation to the creation of Event Media, which you may have against us.

We understand and respect that not everyone may wish to have their photo, video, or audio recorded during our event. If you prefer not to be included in any media documentation, please inform our event staff or designated personnel upon arrival. We will make every effort to accommodate your request and ensure your privacy. By opting out, you acknowledge that reasonable measures will be taken, but we cannot guarantee the complete elimination of your presence in crowd shots or incidental captures.

Media Attendance

GrainGrowers welcomes media interest and attendance at our events, subject to prior notification and acceptance by GrainGrowers. If media wish to attend an event on a complimentary basis, we will provide amenities (i.e. meals and refreshments) where possible, but there is no obligation on the part of GrainGrowers to provide meals or other benefits unless a ticket is purchased in advance. Please note that GrainGrowers reserves the right to restrict media access to any event and direct their conduct during the event.

GrainGrowers would appreciate acknowledgment in any content (such as news articles, TV or radio stories, or online news) generated by the event.

GrainGrowers will enable the media to engage in the question-and-answer sessions at our events unless requested otherwise by the speakers. It is at the discretion of the speakers to make time for media interviews before or after the event. Where possible, GrainGrowers will assist the media in determining if speakers will be available for interviews. Please consult the GrainGrowers team to facilitate any such interview ahead of time.

Cancellation and payment policy

All cancellations must be made in writing to events@graingrowers.com.au. Cancellation by phone will not be accepted.

For cancellations received 1 month prior to the event, a full refund (less any credit card fees) will be issued.

For cancellations received less than 1 month prior to an event, a full refund of the fees paid, minus a $50 administration fee will be provided.

For cancellations received less than 1 week prior to the event, refunds will not be issued. However, name changes for attendees without charge will be accepted within 48 hours of notice.

GrainGrowers reserves the right to vary, amend or cancel any event without notice, including the date, time and location of any event. GrainGrowers is not liable for any travel, accommodation or other costs that you may have incurred in relation to the varied, amended or cancelled event. GrainGrowers will endeavour to provide as much notice as possible for changes to events due to reasons beyond its control e.g. changes to speaker availability.

All event fees must be paid at the time of registration and are inclusive of GST. Should GrainGrowers be required to cancel an event, GrainGrowers will notify you as per the details provided during registration to offer a refund of monies paid.

All event registrations are subject to venue capacity. GrainGrowers reserves the right to refuse registration if the event has reached capacity.

For paid events, all tickets must be paid in full no later than two working days before the scheduled event. GrainGrowers reserves the right to deny entry to delegates who have outstanding fees at the time of the event.

Event cancellation due to a pandemic

(a) GrainGrowers may, in its absolute discretion, cancel an event due to any decision of a government authority in relation to COVID-19, or any threat of COVID-19 beyond the reasonable control of GrainGrowers, which affects GrainGrowers' ability to proceed with holding the event.

(b) If the event is cancelled for a reason set out in clause 1(a), regardless of when such cancellation occurs relative to the date of the event, GrainGrowers will refund in full the ticket price paid by delegates.

(c) A refund may take 10 business days to process.

(d) This clause will not apply if the event is cancelled for any other reason.

Program content

GrainGrowers reserves the right to alter the program prior to or during the event without notice. GrainGrowers will endeavour to ensure the program and schedule is correct at the time of posting. GrainGrowers does not take any responsibility for any errors or omissions to the program or schedule of the event. Please note: not all speakers choose to provide presentation papers.

The intellectual property used in connection with the event, including (without limitation) any text, graphics, photographs, logos or trademarks is owned or licensed by GrainGrowers or the speakers or presenters, unless indicated otherwise.

Dietary Requirements

The Delegate must communicate any specific dietary requirements no later than ten days prior to the event. Acceptance of these terms and conditions implies acknowledgment by the Delegate that failure to provide such notice may result in a meal being served that does not align with their dietary requirements.

Code of conduct

By registering for aGrainGrowers event you are expected to behave in a professional and appropriate manner. GrainGrowers reserves the right to refuse entry to any event or remove the participant from the event premises if their behaviour is deemed inappropriate, disruptive, unacceptable or if the participant is intoxicated. GrainGrowers does not tolerate online or in person, harassment or discrimination of other participants.

Event attendees must be over 18 years of age (unless otherwise specified) and proof of age may be asked at any time. GrainGrowers staff reserve the right to refuse entry to anyone in breach of the code of conduct and to deny access to future GrainGrowers activities.

Insurance

Delegates need to secure their own travel and health insurance. GrainGrowers accepts no responsibility for accident or misadventure including flight cancellations or lost property.

Miscellaneous

These terms and conditions are governed by the laws of New South Wales, Australia. Both you and GrainGrowers submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.

If any provision of these terms and conditions is deemed invalid or unenforceable, all or part of that provision will be severed from these terms and conditions and will not affect the enforceability of the remaining provisions of these terms and conditions.

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under these terms and conditions shall not constitute a waiver of such right.
